North Cyprus Property Lawyers

There are many solicitors listing their services both online and in the newspapers in North Cyprus.  A solicitor is another name for a lawyer.  When you are researching the different lawyers in the area make sure that they are experienced with the process of purchasing a piece of property.  The responsibility of the lawyer is to handle all of the transactions involved with the purchase.

They can also check for the availability of land, make sure that the title deed is taken care of, handle the payment plan details, and also handle the transfer of foreign currency.  The lawyer is also supposed to look over the details of the purchase to make sure that everything is according to the law.  The law is somewhat different in Northern Cyprus than it is in other countries.  If you decide not to hire a lawyer, it would still be a good idea to set up an appointment with a lawyer on a one time basis for them to give you some advice.

There are several unfortunate cases that could arise when you would need a lawyer:

•     The property is sold without the submission of a deed.
•     The property was built illegally and is destroyed.
•     The deed was signed by someone else, or illegitimately.
•     The home has negative structural elements.
•     The home was not fully finished and the builders cannot be found
•     The property is sold to more than one buyer.

How to choose you lawyer:

There are so many different lawyers available in Cyprus, especially online.  If you are looking for a lawyer online, make sure they have excellent recommendations.  Also, look at their previous experience records and qualifications.  You may also want to ask about their past history with purchases and make sure that they have never, or are not, representing the owner of the property.

If you are not going to be able to view the home before you travel to make a deposit, the lawyer can view the home for you and then report back to you.  They can also conduct research about the history of the home to find out who was the first owner.  If you are building a home, you can ask that they arrange an appointment for an inspector to view the construction work and the permit.  Also, check to make sure that the lawyer can communicate with you in your native language, both verbally and on paper.

Along with the legal aspects, the lawyer should also make sure that the Title Deeds are complete and taken care of.  They are also supposed to organize a Contract of Sale form.  You can request that they apply and submit your application to the Council of Ministers for permission to purchase the property.  They are also required to work with you until the deed is placed into your name.  If you have to have your funds transferred into the Cyprus currency, then you can request that they handle the procedure.  The lawyer is required to give you the best advice concerning tax rates, confidential information, the legal process, and the purchase details.
